 সন্দেহের অবকাশ আছে

প্রশ্ন হল একজন বিচারক অবসর গ্রহণের অব্যবহিত পরে বা কর্মকাল শেষ করার কয়েক মাস আগে স্বেচ্ছা অবসর নিয়ে সক্রিয় রাজনীতিতে যোগদান করা সমীচীন কি না ! এটা সর্বজনবিদিত যে, বিচারক এবং রাজনীতির সমন্বয় সর্বদাই বিচার বিভাগকে স্বাধীন ও নিরপেক্ষ প্রতিষ্ঠান হিসেবে জনগণের ধারণাকে প্রভাবিত করবে। বিচার বিভাগের নিরপেক্ষতা নিয়ে প্রশ্ন উঠতেই পারে।

রাজনীতিতে আসা কি রাজনৈতিকভাবে সংবেদনশীল এলাকায় বিচারকের নিরপেক্ষতা নিয়ে সন্দেহ সৃষ্টি করে না? এটা কি বিচারের নৈতিকতার নীতি লঙ্ঘন করে না এবং সামগ্রিকভাবে বিচার বিভাগের ক্ষতি সাধন করে না? সমতুল্য আরও একটা উদাহরণ দেওয়া যায়। সিবিআই-এর ডিরেক্টর অবসর নেওয়ার পরে যদি একটি বড় কোম্পানিতে যোগ দেন, যেটি সিবিআই-এর তদন্তাধীন ছিল, তাঁর প্রতিক্রিয়া কী হবে? এটা মানুষকে প্রশ্ন চিহ্নের মুখে দাঁড় করিয়ে দেয় এবং জনমানসে অবিশ্বাসের বাতাবরণ সৃষ্টি করে, যে কলকাতা হাইকোর্টের মাননীয় বিচারক, যিনি সম্প্রতি বিজেপিতে যোগদান করেছেন, তিনি খুব সম্প্রতি বিচারের আসন অলঙ্কৃত করা সত্ত্বেও নিরপেক্ষ রায় দিয়েছিলেন কি না ?

Casting a doubt

It is well known that co-mingling of judges and politics will always harm the public perception of the judiciary as an institution that is supposed to be independent and non-partisan. The question is whether it is right for a judge to join active politics, either after retirement or by resigning from judicial office. Does not venturing into politics cast a doubt on the impartiality of the judge in politically sensitive areas ? Does this not violate the tenets of judicial ethics and harm the institution of the judiciary as a whole ? What will be one's reaction if the CBI director, after his retirement,  joins a big company, which was being subjected to investigation by the CBI? Will it not be foolish to believe that the Calcutta Highcourt judge, who recently joined the BJP, gave judgements that were unbiased and impartial while he was on the bench until very recently?
